Pennsylvania is still medical only. As of late 2026, recreational weed is not legal anywhere in the state, Philly included. You can't walk into a dispensary here without a state medical card, and the state still treats possession without one as a crime.

Philly softens that a lot inside city limits, and New Jersey, right over the bridges, is fully legal for anyone 21 and up. So the real answer depends on which side of the river you're standing on and who's writing the ticket. Here's the whole picture, then go read where to smoke for the practical side.

Pennsylvania weed laws: where legalization stands

Close, but not there. Gov. Josh Shapiro has put adult-use legalization in his budget proposals year after year, and every final budget so far has left it out.

The House has passed a legalization bill before, one that would have sold weed through state-run stores, and it died in the Republican-controlled Senate. A bipartisan Senate bill from Sen. Sharif Street, a Philly Democrat, and Sen. Dan Laughlin, an Erie Republican, would set up private shops instead. It's been stuck in committee.

The state Senate is the wall. Until something actually passes and gets signed, assume nothing has changed, and if it does change, the whole state will hear about it.

How to get a PA medical marijuana card

This is the only legal way to buy weed in Pennsylvania. The program has been around since 2016, and the state says it serves hundreds of thousands of patients. The process is pretty simple.

First, register on the state's patient and caregiver registry. Second, get certified by a practitioner approved by the Pennsylvania Department of Health. A lot of Philly patients do this over telehealth now. Third, pay the $50 card fee within 60 days of certification, or the certification lapses. The fee is waived if you're enrolled in Medicaid, PACE/PACENET, CHIP, SNAP or WIC. Your physical card comes in the mail, and then you can shop at any licensed PA dispensary. Some want an appointment on your first visit.

Certifications last up to a year, depending on what your practitioner sets, and the state emails you before your annual payment is due.

Qualifying conditions: the state list has 23 serious medical conditions, including cancer, epilepsy, MS, Parkinson's, PTSD, HIV/AIDS, Crohn's disease, terminal illness, and severe chronic or intractable pain. Whether you qualify is between you and the practitioner. Ask your doctor.

Two things trip people up. You must be a Pennsylvania resident with a PA driver's license or state ID. And Pennsylvania doesn't accept out-of-state medical cards, so a New Jersey or New York card won't get you into a PA dispensary. Also, PA dispensaries sell flower, but the program says it's for vaporizing, not smoking. Smoking it is technically outside the rules even with a card.

Can tourists buy weed in Philadelphia?

No. Every dispensary in Pennsylvania is medical only and needs a PA medical card, and you need PA residency to get one. Visiting with a card from your home state doesn't help. There's no legal way for a tourist to buy weed in Pennsylvania right now.

New Jersey is a different story. It's fully legal for adults 21 and up, and licensed dispensaries sell to visitors with a valid ID. The closest ones are in Camden County, a few miles past the bridges. New Jersey law caps a single purchase at an ounce of flower, or the equivalent in concentrates, vapes or edibles, and adults can possess up to six ounces in NJ. New Jersey also has a licensed consumption lounge in Merchantville. NJ bans public use too, so the same private-property rules apply over there. Details live on the where to smoke page.

Driving high in PA: the strictest part

This is the one rule everybody should actually know. Pennsylvania's DUI law, 75 Pa.C.S. Section 3802(d), makes it illegal to drive with any amount of a Schedule I substance or its metabolite in your blood. Weed is still Schedule I under state law. There's no impairment threshold like the .08 for alcohol.

That means you can be charged without being high at all, because THC metabolites can stick around in your system for days or weeks after a sesh. Medical patients are not exempt. Lawmakers in Harrisburg have introduced bills to protect unimpaired medical patients, but none has become law as of this writing.

So the move is simple. Let somebody else drive. SEPTA, rideshare, a sober friend. Plan the ride home before you smoke, not after.

CBD and hemp in Pennsylvania

Hemp-derived CBD is everywhere in Philly, from corner stores to smoke shops. The bigger shake-up is federal. Congress passed a law redefining hemp so that products can contain no more than 0.4 mg of total THC per container. That would effectively ban most intoxicating hemp products, like delta-8, delta-10, THCA flower and a lot of full-spectrum CBD, and the start date has already been pushed back once.

Pennsylvania lawmakers have also been working on a state ban on intoxicating hemp THC, including delta-8, delta-10 and THCA. If you've been grabbing THCA flower or delta gummies at the gas station, expect those shelves to look different. Health questions about any of it: ask your doctor.

Once you've got the rules down

The fun part. Philly is a serious food town after dark, so start with the eat guide. Stay in with the watch list, or get out and see some stuff. If you're new to town, the neighborhood guides tell you which part of the city fits your speed.
